Appeal by the plaintiff, William Solomon, from a judgment of the Supreme Court in favor of the defendant, entered in the office of the clerk of the county of Erie on the 2d day of February, 1903, upon the verdict of a jury, and also from an order entered in said clerk’s office on the 25th day of February, 1903, denying the plaintiff’s motion for a new trial made upon the minutes.

Spring, J.:
On August 22, 1901, the plaintiff, a guest of Lautz Brothers, & Co., was riding on their coach crossing the tracks of the defendant on Main street in the city of Buffalo when a collision occurred with a car, overturning the vehicle and injuring the plaintiff. Main street extends north and south and Scott street enters it from the east but does not cross. Lake and Hanover streets intersect with Main on the west, Lake coming in from the northwest and Hanover from the southwest.
