In a probate proceeding in which the petitioner filed a final account of the estate of Olga Asta Ziomek, also known as Olga Ziomek, the petitioner Arthur Ziomek appeals from an order of the Surrogate’s Court, Suffolk County (Czygier, S.), entered May 17, 2006, which denied his motion pursuant to CFLR 3212 for summary judgment dismissing the objections to the account.
Ordered that the order is reversed, on the law, with costs, and the petitioner’s motion for summary judgment dismissing the objections to the account is granted.
