Counsel for defendant has applied to the court for an order setting aside the jury verdict in this malpractice case that found liability and awarded damages to the infant plaintiff (CPLR 4404 [a]).
The action herein is one for medical malpractice that resulted in injury to the infant plaintiff, Kyla Harding. After several days of testimony, the jury returned a verdict finding defendant Adedayo Onibokun negligent; finding that the negligence was a substantial factor in causing plaintiff Kyla Harding’s injuries; and awarding damages.
