1. Under repeated rulings of this court, an assignment of error based upon a refusal to grant a nonsuit will not ordinarily be considered, when thereafter the case proceeds to verdict and judgment, and a motion for a new trial is made which *155contains the ground that the verdict is contrary to law and the evidence.
