A joint decision is rendered in these two disparate proceedings to resolve a common legal issue of much concern to the Bench and Bar, to wit, the meaning and legal implications as to enforceability of the recent new legislative pronouncement contained in Social Services Law § 383-c entitled "Guardianship and custody of children in foster care”, effective January 1, 1991.
