The plaintiff, Thomas A. King, instituted this suit in the district court of Wilbarger county against the defendant, E. Hayes Sie-ber, to recover damages in the sum of $5,-800, alleged to have been occasioned by the fraudulent representations made to the plaintiff by the defendant relative to the amount and value of certain real estate.

The case was submitted to the court without the intervention of a jury, and judgment rendered that plaintiff take nothing by his suit, from which judgment the plaintiff, hereafter called appellant, by writ of error prosecutes this appeal.
