This is an action of unlawful detainer, brought by the appellant against the appellee to recover the possession of a certain tract of land situated in the Cherokee Nation. The complaint is as follows: “Plaintiffs state; That Rachel F. Thomason is a married woman, and that her husband is the coplaintiff, John S. Thomason, and that they both reside *2in the Northern district of the Indian Territory, and that they have two minor children, who are citizens by blood of the Cherokee Nation, and all of them are entitled to take allotment in said Nation and they desire to take the lands incon-troversy…
