The defendant was charged in a county attorney’s information filed in the district court of Page County, Iowa, with the crime of larceny from the person of Jennie Maxwell of a sum of money in excess of $20. The defendant entered a plea of not guilty. A trial was had and on submission of the case to the jury it returned a verdict of guilty of the crime of larceny of property in excess of $20. A motion for a new trial, including exceptions to instructions, was later submitted and was overruled by the trial court. The defendant thereafter was sentenced to imprisonment in the state penitentiary…
