This action in equity was originally instituted in the McLean Circuit Court, and by change of venue was heard and determined in the Daviess Circuit. Upon the filing of the petition the appellants obtained an injunction enjoining and restraining the appellee (Smallhouse), who was one of the members of the Green and Barren Diver Navigation Company, from collecting any tolls from the appellants by reason of the passage of their boats in and through the lochs on said rivers, the appellee being at the time the agent of the company, and authorized by the company to collect tolls.
