MEMORANDUM OPINION
GESELL, District Judge.
These cases involve motions to dismiss indictment for abortion brought under Title 22, See. 201, of the D.C.Code. Vuitch is a physician licensed in the District of Columbia; Boyd is a nurse’s aide. There is no relation between the two except that each defendant has moved to dismiss the indictment on the ground that the District of Columbia abortion statute is unconstitutional.
