This proceeding was Brought pursuant to sections 2675 and 2676 of the Code of Civil Procedure.
The petitioner, the executor of the last will and testament of the decedent, alleges that certain moneys which at the time of her death were deposited in a savings Bank in the name of “ Sabina Beagan in trust for Catherine T. Mulligan ” are in the possession of the respondent and should be delivered to him. The respondent in her answer claims title to the deposit in question.
