TRIEBER, District Judge.

This is an action by a trustee* of a bankrupt estate to set aside a deed of trust in the nature of a mortgage executed by the bankrupts to the defendant Semmes, as trustee for his codefendant, Rainer & Connell Company, a corporation, to secure an, indebtedness of $125,000, evidenced by a number of notes of the bankrupts, which trust deed was executed within four months of their adjudication as bankrupts, to secure a pre-existing indebtedness of the *747bankrupts. The proper allegations necessary to maintain the bill are set out-in the complaint.
