Motion to Remand

Plaintiff moves to remand this case to state court.1 This motion is opposed.2 Oral argument was not requested and is not deemed necessary.

Background

Plaintiff is John S. Dalby. Defendants are Ditech Financial, LLC and Federal National Mortgage Association (FNMA).

Plaintiff alleges that in 2007, he took out a home loan from Countrywide Bank and that this loan was memorialized by a Deed of Trust.3 The Deed of Trust was allegedly thereafter assigned to Bank of America, then Green Tree Servicing LLC, and finally to Ditech in 2016.4…
