Defendant has filed a motion for partial summary judgment with respect to plaintiffs’ claims based upon unintentional conduct and submits that an earlier summary judgment ruling found the plaintiffs to be contributorily negligent as *372a matter of law. Defendant has also presented another motion for summary judgment seeking to reopen an economic loss doctrine issue which was previously rejected by two other judges of this court.
