I am unable to concur in the views expressed in the majority opinion. This was an action to recover damages on account of the negligent acts of defendants. Plaintiff alleges that he was riding in an automobile driven by his wife on the public highway at a reasonable and legal rate of speed, not in excess of 30 miles per hour, and was operating the same in a prudent and careful manner; that the defendant A. L. Butts, an employee of the Mid-Kansas Oil & Gas Company, was driving a Buiek coupe, owned' by said company, in a northerly direction on the east side of the middle line of the paved…
