PRICE, Chief Justice.

This case involves the contest of the will and codicil of Clara Kirkland, of Sutton County, who died there August 16, 1941. She left an estate consisting of ranch, livestock, town property, notes, cash and other personalty. The estate was of *645large value. The will and codicil in question were filed for probate in Sutton County August 19, 1941, by B. W. Hutcherson, named as independent executor in the will. The contestants were nieces and nephews of the testatrix. The grounds of contest urged were mental incapacity, undue influence, fraud and deceit, and lack of knowledge…
