This action is founded upon a stop notice given to the owner of a' building by a creditor of the building contractor, under the provisions of the Mechanics’ Lien law. The plaintiff had judgment in the trial court.

The building contract in question was filed April 5th, 1898. At that time the provisions of the supplement of 1895 to the revised Mechanics’ Lien act of 1871- were in force (Pamph. L. 1895, p. 313; Gen. Stat., p. 2073), but the moneys claimed by the plaintiff became due to him, and his stop notice and the other stop notices in…
