L. J. Palmer, hereinafter called plaintiff, brought this action against Pat Kelly, hereinafter called defendant. From the allegations of the second amended complaint, upon which the case was tried, we gather that plaintiff’s contention is that on the 17th day of May, 1934, he sold to Wilbur C.
