This suit had its inception as one to foreclose a real *30estate mortgage brought by .the Kansas City Life Insurance Company against the Neverves, owners and mortgagors of the real estate. The Cowles-White Lumber Company brought a separate suit to foreclose a mechanic’s lien on the same real estate, and numerous others filed cross-petitions seeking foreclosure of mechanics’ liens. These suits were consolidated, and all parties tried their issues in one trial.
