Order, Supreme Court, New York County (Stuart Cohen, J.), entered on or about February 26, 1996, which granted defendants’ motion for summary judgment dismissing the complaint and granted the cross-motions of the third-party defendants Fred Lumpp & Son, Inc. and Coopers and Lybrand for summary judgment dismissing the complaint and the third-party complaint, modified, on the law, to deny the motions insofar as they dismissed *392claims based upon 12 NYCRR 23-1.7 (e) (2) and to reinstate those causes of action, and otherwise affirmed, without costs.
