The present appeal arises from an action in negligence seeking reimbursement for damages resulting from an extensive fire in a newly constructed apartment building in the City of Troy. Plaintiff insurance company is the subrogee of the Melron Construction Company, owner and builder of the Somerset Park apartment complex in Troy, Michigan. Defendant Muskovitz & Pershin & Sons, Inc., are plumbing and heating contractors who were in the process of installing an air conditioning unit in the apartment house at the time of the fire.
