This is an action of tort in which the plaintiff seeks to recover for personal injuries and property damage arising out of the collision of motor vehicles. The answer is a *182general denial, contributory negligence and violation of law.

At the trial, there was evidence tending to show the following:

The accident occurred on November 15, 1963 at about 4:50 p.m. on Route C-l, near Revere Drive-In Theatre. Immediately prior to the time of the accident, traffic was heavy with three lanes of traffic travelling northerly at about 40-45 miles per hour. The weather was clear, and the road was dry.
