The plaintiff, an attorney and counsellor at law, brought an action for damages for the individual defendant against the corporation defendant for personal injuries caused by the negligence of the latter to the former. Issue was joined by the service of an answer, and the day before the cause was reached for trial the parties came together and settled the action without the consent of the plaintiff’s attorney, for the sum of $450, which the defendant therein paid to the plaintiff therein, taking from him a general release.
