FOLLEY, Justice.

This appeal involves the action of the trial court in sustaining general demurrers to the petition of the plaintiff in error, Ed Trigg, and the dismissal of his cause of action upon his refusal to amend his pleadings. We shall designate the parties as they were known in the trial court.

The plaintiff, Ed Trigg, filed the amended petition herein involved on July 23, 1937, the original petition having been filed on November 29, 1935. The heirs and legal representatives of J. A. Whitten-burg, deceased, and the Phillips Petroleum Company, lessee of Whittenburg, were the •defendants…
