This is an action for recovery of damages arising out of a collision between an automobile, driven by plaintiff’s intestate, Paul Moore, a white boy 17 years of age, and one of respondent’s regular passenger trains, said collision hav ing occurred at a crossing on the outskirts of the Town of Sellers in Marion County, about. 1:00 o’clock p. m., August 11, 1934, resulting in the instant death of the said Paul Moore.
