This is an appeal from an order fixing inheritance taxes.
John B. Elston died on November 5, 1936, leaving an estate valued in the sum of $75,794.34. A holographic will, dated September 12, 1935, bequeathed a certain sum to a sanatorium and other amounts to three nieces and two strangers. It also provided as follows; “I appoint A. C. Wyckoff my Executor without bond, he to receive 10% (ten percent) of personal property, and he to handle the residue of estate, if any, for the benefit of my relatives most in need.” On October 30, 1936, by codicil, the following provision was made: “It is…
