CHRISTIAN, Judge.

The offense is embezzlement; the punishment, confinement in the penitentiary for two years.

Appellant was an employee of the Farmers Gin Company of Santa Anna, Texas, a corporation. On the' 22nd of September, 1937, by virtue of his employment, appellant received $92.73 belonging to said incorporated company. According to the testimony of the State, appellant embezzled said money and appropriated it to his own use and benefit.
