White’s indictment charged that on August 23, 1969, he “at Lexington, in the County of Middlesex ^Massachusetts] . . . did steal one motor vehicle of the property of Luc Savaria.” White moved to dismiss the indictment on the ground that the Superior Court lacked jurisdiction. The motion was allowed. The Commonwealth appealed under G. L. c. 278, § 28E, inserted by St. 1967, c, 898, § 1. The parties stipulated, “solely for the purposes of . . .
