This action was brought to recover rent due on a lease dated July 28, 1888. It is recited to be njade “ between Jacob Beidler, party of the first part, and the Rochester Boot and Shoe Company, by Nathan Newfeld, president, party of the second part.” The covenants are all by the “ party of the second part,” and the testimonium clause is:

“ Witness the hands and seals of the parties hereto, the day and year first above written.”
