*1356Appeal from a judgment of the Supreme Court (McGrath, J.), entered September 22, 2010 in Albany County, which dismissed petitioner’s application, in a proceeding pursuant to CPLR article 78, to review a determination of the Board of Parole denying petitioner’s request for parole release.
In October 1980, following the shooting of a deputy sheriff, petitioner was convicted of attempted murder in the first degree and sentenced to a prison term of 20 years to life.
