SMITH, J,

FINDINGS OF FACT(1) On January 15,1994, at approximately 3:40 a.m., officers from the Cumru Township Police Department were dispatched to the scene of a motor vehicle accident on New Holland Road (State Route 625), Berks County, Pennsylvania.(2) Officer David Hain of the Cumru Township Police Department was one of the first officers at the scene. Upon his arrival, Officer Hain observed a 1989 Plymouth Sundance resting against a bridge abutment.(3) Officer Hain further observed a person seated in the driver’s seat.
