This appeal is from a decree in favor of appellee, the C. D. Gammon Company, for the specific performance of a contract for the erection and leasing of a building, with an option to buy it at any time during the term of the lease. The Standard Trust and Savings Bank, as trustee, held the title to the property for the beneficial owner, F. J. Lewis. The contract was entered into by the trust and savings bank and the Gammon Company on August 1, 1924.
