Plaintiffs move for an order to dismiss an appeal taken by the defendant to the County Court from a judgment in the Justice’s Court of the Town of Clarkstown.
*219After a trial in the Justice’s Court of the Town of Clarkstown a judgment was rendered in favor of the plaintiffs in the amount of $352.50. In April, 1965 the defendant served a notice of appeal wherein the defendant demanded a new trial in the County Court of Rockland County. This is authorized by section 442 of the Justice Court Act.
