Appeal from an order of the Court of Claims (McCarthy, J.), entered November 30, 2012, which, among other things, granted defendant’s motion for summary judgment dismissing the claim.
Claimant contends that he sustained a serious injury within the meaning of Insurance Law § 5102 (d) when his vehicle was in an accident with a vehicle owned by defendant and operated by defendant’s employee, Kristina Honsinger.
