KENNAMER, District Judge.

The plaintiff in error, Martin J. Gray, was charged, by information filed in the District Court for the Western District of Missouri, with the violation of the National Prohibition Act (Comp. St. § 1013814 et seq.). The first count of the information charged the plaintiff in error with the unlawful possession of intoxicating liquors; the second, with the unlawful sale of intoxicating liquors. The ease came on for trial in its regular order on the 10th day of November, 1925, at which time a motion filed by the plaintiff in errof for a continuance was overruled. The…
