Plaintiff, a stock raiser, sought injunction of the erection and maintenance of a fence, by means of which, as he alleges, defendant,. also a stock raiser, excludes and will exclude him from public lands of the United States. Erom a final judgment dissolving the restraining order and denying- relief, he has appealed.
