Dear Mr. Simmons:

As acting secretary for the Kansas department of corrections, you request our opinion regarding the use of deadly force to prevent the escape of a committed sexually violent predator.

Upon a unanimous jury determination that a person is a sexually violent predator (predator), such person is committed to the custody of the secretary of social and rehabilitation services (SRS) for control, care and treatment for an indefinite period of time. L.…
