This is an appeal by the People of the State of Illinois in a criminal case pursuant to Supreme Court Rule 604(a) (111. Rev. Stat. 1977, ch. 110A, par. 604(a)). The defendant, Fred Gulley, successfully persuaded the Circuit Court of Peoria County to dismiss two indictments charging him with unlawful delivery of heroin.
