This is an appeal on questions of law from a judgment of the Common Pleas Court in favor of defendants, appellees herein. The case was submitted on an agreed statement of facts.
Plaintiff, appellant herein, was appointed as police constable by the Liberty Township Trustees in January 1960, and served until April 23, 1963, when he was discharged. Since 1961, John Bluedorn has served as Chief of Police of Liberty Township, and, sometime during 1961, he was orally given authority by the Liberty Township Trustees to hire and fire the personnel of the Liberty Township Police Department.
