Complainant owns and resides upon certain land in section 3, Clarence township, Calhoun county. Along the highway in front of his house is a county drain running towards the west, known as the “Ponto-Lininger Drain,” established more than 20 years ago. When this drain was constructed, in consideration of a right of way across his front, two tiers of 15-inch tiling, one above the other, five rods long, were put in by the authorities and the ditch filled in solidly, making an approach from the road into his premises.
