Defendant-Appellee Gregory Orozco was convicted by a jury of conspiracy to distribute and possess with intent to distribute 50 grams or more of methamphetamine, 21 U.S.C. § 846 (Count 1), and possession with intent to distribute five grams or more of methamphetamine, 21 U.S.C. §§ 841(a)(1), 841(b)(1)(A)(viii) & 18 U.S.C. § 2 (Count 2). Mr. Orozco then filed a motion for a new trial alleging that the government violated his Sixth Amendment right by interfering with his right to call a witness on his behalf.
