(concurring)—I agree with the majority's conclusion that Oden Inv. Co. v. Seattle, 28 Wn. App. 161, 622 P.2d 882, review denied, 95 Wn.2d 1015 (1981) and Vance v. Seattle, 18 Wn. App. 418, 569 P.2d 1194 (1977) require affirmance.
