—In a proceeding pursuant to CPLR article 75 to vacate an arbitration award dated March 5, 1990, the petitioner Lionel Dasrath appeals from an order of the Supreme Court, Kings County (Spodek, J.) dated July 13, 1990, *570which granted the cross motion of the respondent State of New York to dismiss the petition.
Ordered that the order is affirmed, with costs.
