PARDEE, Circuit Judge.

The question involved on this appeal is as to the proper location of the north line of section 4,- a school section of railroad land in Tyler county, Tex., originally surveyed August 4, 1874, by M. L. McAlister, deputy surveyor of Tyler county. The field notes are:

“Field notes of a survey of (640) six hundred and forty acres of land made for the B. B. B. & C. R. R, R. Company, it being the quantity of land to which they were entitled by virtue of certificate No. 647 issued to said company by W. S. Hotchkiss, Com. Claims, March 30th, 1860.
