ORDER ON PLAINTIFF’S MOTION TO DISMISS DEFENDANTS’ COUNTERCLAIM

THIS CAUSE is before the court on Plaintiffs motion to dismiss Defendant’s Counterclaim pursuant to Federal Rule of Civil Procedure 12(b)(6) [D.E. 22], Defendants have filed a response to Plaintiffs motion in which they seek leave of court to amend- the Counterclaim [D.E. 24], and Plaintiff has, in turn, filed a reply [D.E. 25].
