In August, 1920, Mary J. Wallace (formerly Mary J. Whittaker) and her five children, all of whom were heirs of Herbert Whittaker, deceased, son of Mary, filed their bill in the circuit court of Cook county to declare a deed to an apartment building absolute on its face to be a mortgage and to redeem therefrom, and for partition. At the time the deed in question was made the title to the property was in the mother of Herbert Whittaker.
