Appellant Monteo, Inc., appeals from an order of the United States District Court for the Southern District of New York, Mary Johnson Lowe, Judge, affirming an order of the bankruptcy court dated November 24, 1978 (“1978 Order”), that amended an order dated May 13, 1976 (“1976 Order”). The 1978 Order vacated so much of the 1976 Order as had authorized the debtor in possession, Emergency Beacon Corporation (“EBC” or “debtor”), to issue a certificate of indebtedness to Monteo for $275,000.
