RYAN, Chief Judge.

Plaintiff, Harold F. Ritchie, Inc., a New Jersey corporation, has filed this suit against defendant Chesebrough-Pond’s Inc., a New York corporation, al- Ieging trademark infringement and unfair competition.

Jurisdiction is predicated on the Lan-ham Act (15 U.S.C.A. §§ 1114, 1121), with pendent jurisdiction of the claim of unfair competition (28 U.S.C.A. § 1338(b)).

Plaintiff seeks an injunction against continued use of the word “Valcream” to describe defendant’s product and against the continued use of packages where the contents and labels are alleged to be misleadingly…
