This cause has been very ably argued orally and in writing. It is important both as respects the principle-involved and the amount in controversy. In discussing the-several questions presented for our consideration, it will be convenient to consider them in the order in which they have been treated in the petition for an appeal. The first is, whether James Caskie is to be held answerable as executor, or merely as surviving partner, for the funds which came into his hands after the death of John Caskie, and which are the subject of this controversy.
