OPINION
ORME, Judge:
[ 1 Defendant Manuel Hurtado Rincon appeals his conviction for identity fraud, a see-ond degree felony. See Utah Code Ann. § 76-6-1102 (LexisNexis 2012) 1 We reverse.
BACKGROUND
